1. Acceptance of Terms

By downloading, installing, or using Aura Tuner ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Aura Tuner is a chromatic tuner and key analyzer application for iOS, macOS, and watchOS. The App provides real-time pitch detection, instrument tuning, key detection, and related audio analysis features. The App operates entirely on your device and does not require an internet connection.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms and the Apple Media Services Terms and Conditions.

4. User Conduct

You agree not to:

• —Reverse engineer, decompile, or disassemble the App
• —Modify, adapt, or create derivative works based on the App
• —Distribute, sublicense, lease, or lend the App to third parties
• —Use the App for any unlawful or unauthorized purpose

5. Intellectual Property

All intellectual property rights in and to the App, including but not limited to its design, code, graphics, and content, are owned by Aura Tuner. These Terms do not grant you any rights to our trademarks, logos, or brand identity.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, uninterrupted, or that tuning results will be perfectly accurate in all environments and conditions. Aura Tuner is a tool intended to assist musicians and should not be relied upon as the sole reference for professional calibration.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Aura Tuner and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, regardless of the cause of action or the theory of liability.

8. Microphone & Audio Access

The App requires microphone access to function. On macOS, the App may also use system audio capture via ScreenCaptureKit. You are responsible for ensuring you have the right to capture and analyze any audio processed by the App. All audio is processed locally on your device and is never recorded or transmitted.

9. App Store Terms

Your use of the App is also subject to the terms and conditions set forth in the Apple Media Services Terms and Conditions. In the event of any conflict between these Terms and the Apple terms, the Apple terms shall prevail with respect to the use of the App on Apple platforms.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the "last updated" date at the top of this page. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
